Terms and Conditions
1. All deliveries are based on our terms and conditions. By ordering our goods the customer accepts these conditions without exception.
2. Valid price is the one showed in our online-shop at www.terraplant.nl at the date of ordering.
3. All prices including VAT.
4. All offers and prices are without engagement.
5.The goods remain our property until payment is totally made.
6. Delivery is made against advance payment (time limit for payment: 2 weeks after order date), cash on delivery. In case of default we are entitled to require reminder fees and default interest. For failed direct debit we charge a fee of € 10.
7. In case of damaged package you are asked to proceed as follows:
If packing is stripped, open package immediately in presence of supplier and complain. You will immediately inform us by phone or letter. In case of postal package you have to reclaim at your postal office.
In case of delivery by any other dispatcher settlement of damage is made by us. As soon as damage is regulated, you will get a credit note, payment or replacement of damaged goods..
8. Warranty period is 24 months after receipt of goods. Warranty is only valid for defects that are existing while transition of liability. Small customary and technical deviations of quality do not justify claims of warranty. Living plants are not unther warranty
A defect of goods has to be claimed in written form. Apparent damage has to be claimed immediately.

In case of defects terraplant.nl Is entitled to choose between settling of defect (rework) or replacement of goods. In case of failure of settling the defect or if terraplant.nl Is not able to make replacement delivery or delivery can not be made for reasons that lie within the responsibility of terraplant.nl, the customer has the right to annul the purchase contract or to demand reduction of price.
The costs for resending goods are taken over by customer. In case of warranted complainment the costs will be reimbursed by terraplant.nl. The warranty does not concern the normal wear and tear.
We are not liable for consequential damage that accrued by defect goods.
10. According to § 2 Fernabsatzgesetz we grant the following right of retraction:
You are not bound to your order if you retract within a period of 2 weeks after delivery of goods. The retraction does not need to contain any reason and has to be made in written form (e-mail is sufficient) or by resending goods (at our risk). For saving retraction period sending in time is sufficient. Use following address:

Customer is committed to bear the costs of resending if deliverd material complies to ordered ones and the price of resended material does not exceed EUR 40 also if amount is higher and customer has not paid at the moment of retraction. Otherwise the resending is free of charge.
Individual manufactured goods (f.e. Terrariums with special measures) are excepted from retraction.
Furthermore we grant you an additional right of return up to 30 days. If the goods are sent after 14 days (but still within the 30-days-period) to us or if contract has not been retracted within the 14-days-period, customer has to bear resending costs.
Please send only back packages with sufficient postage. Unless we have to pay postage due that will be reducted from refund amount. In case of usage or damage of goods or missing original packing we will reduce the legally allowed amount. We refund the postage that accrue by mailing with TNTPost.
Forwarding costs for shipment to customer will not be refunded.

12. All contracts are under law under exclusion of UN law.
